1. Introduction

Welcome to Velvet Circle. By creating an account, submitting an application, or using any part of the Velvet Circle platform, you agree to be bound by these Terms & Conditions. If you do not agree, you must not use the Platform.

2. Eligibility

You must be at least 18 years of age to use the Platform. By creating an account, you confirm that you are 18 years or older. We reserve the right to request proof of age at any time and to immediately terminate accounts where age verification cannot be satisfactorily provided.

3. Account Registration & Conduct

You agree to provide accurate, complete, and current information. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

4. Content Standards & Creator Responsibilities

You are solely responsible for all content you upload and must ensure that:

• All content features only you, or individuals who have given explicit, informed, and documented consent.
• All individuals featured are at least 18 years of age.
• No content depicts, promotes, or facilitates any illegal activity.
• No content contains material involving minors, non-consensual activity, coercion, trafficking, bestiality, extreme violence, or any content we determine to be harmful or exploitative.
• You hold all necessary rights, licences, and permissions to upload and display your content.

5. Partner Content & Consent

Where content features any individual other than yourself, you must:

• Obtain and retain written, informed consent from every individual prior to upload.
• Confirm consent through the Platform's verification process at the time of upload.
• Be prepared to provide evidence of consent upon request at any time.

Failure to demonstrate valid consent will result in immediate content removal and may result in account termination and referral to authorities.

6. Prohibited Content & Zero-Tolerance Policy

Velvet Circle operates a strict zero-tolerance policy:

• Any content involving individuals under 18 years of age.
• Non-consensual intimate imagery (including deepfakes).
• Content promoting human trafficking, sexual exploitation, or coercion.
• Content depicting illegal activity of any nature.
• Harassment, hate speech, discrimination, or threats.
• Content involving animals in a sexual context.
• Any material that, in our sole judgement, falls into a legal or ethical grey area.

7. Right to Suspend or Terminate

Reasons include but are not limited to:

• Any breach, or suspected breach, of these Terms.
• Any content approaching or crossing the boundary from acceptable to questionable territory.
• Any conduct harmful, exploitative, dishonest, or contrary to our values.
• Any failure to provide evidence of age, consent, or content rights upon request.
• Any action posing a risk to the Platform, its community, or any individual.

Upon termination, we may remove all content, retain records for legal purposes, report suspected illegal activity to law enforcement, and refuse future applications.

There is no right of appeal against termination decisions. Our decision is final.

8. Intellectual Property

You retain ownership of all content you create and upload. By uploading, you grant Velvet Circle a non-exclusive, royalty-free licence to display your content in accordance with your visibility settings.

9. Privacy & Data

Personal data is processed in accordance with UK data protection legislation including the UK GDPR and Data Protection Act 2018. We will never share your personal information with third parties without consent, except where required by law.

10. Fees & Payment

Certain features and services may be subject to fees. All pricing will be clearly communicated before any commitment is required.

11. Limitation of Liability

To the fullest extent permitted by law, Velvet Circle shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

12. Indemnification

You agree to indemnify and hold harmless Velvet Circle from any claims, liabilities, damages, losses, and expenses arising from your use of the Platform or breach of these Terms.

13. Governing Law

These Terms are governed by the laws of England and Wales. Disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Amendments

We reserve the right to update these Terms at any time. Continued use after changes constitutes acceptance.
